Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. Prompt Generator is a tool that uses a third-party generative Artificial Intelligence (AI) model to transform user-provided text ideas into detailed, structured prompts for use with other AI services (e.g., text or image generation models).

2. Intellectual Property Rights

• Our Service: We own all rights, title, and interest in and to the Service, including its software, user interface, branding, and all related content, features, and functionality. You may not copy, modify, or reverse engineer any part of our Service.
• Your Content: You retain all ownership rights to the initial text and ideas you input into the Service (“Input”). You also own all rights to the prompts generated by the Service based on your Input (“Output”). You are free to use the Output for any purpose, including personal or commercial use, subject to these Terms and the terms of any third-party service you use it with.

3. User Responsibilities and Conduct

You are solely responsible for your Input and for how you use the Output. By using the Service, you agree not to provide Input that:

• Is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Infringes on any third party’s intellectual property rights, including copyright, patent, or trademark.
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

We are not responsible for the content of your Input or the consequences of you using the Output.

4. Third-Party Services

The core functionality of our Service relies on the Google Generative AI (Gemini) API. By using our Service, you acknowledge and agree that your Input will be processed by Google. Your use of the Service is also subject to Google’s terms and policies, which can be found on their website. We do not control and are not responsible for the availability, accuracy, or content of third-party services.

5. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the operation or availability of the Service, or the accuracy, reliability, or completeness of the Output. The Output is generated by an AI and may contain errors, inaccuracies, or be unsuitable for your specific purpose. You use the Service and its Output at your own risk.

6. Limitation of Liability

In no event shall Prompt Generator, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any content or Output obtained from the Service; and (iii) any unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not to a breach of the Terms.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by updating the “Last Updated” date of these Terms. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Belarus, without regard to its conflict of law provisions.
